Terms of Use
By accessing or using PlateCalibrate, you agree to these Terms of Use (“Terms”). If you do not agree, please do not use the service.
1. Nature of the service
PlateCalibrate is an experimental web service that uses artificial intelligence (AI) to provide approximate calorie estimates and plate-balance assessments based on photos of meals you upload.
The service is aimed at increasing awareness of what is on your plate. It provides approximations only. Actual calories and nutritional values can differ significantly depending on ingredients, portion sizes, cooking methods, and many other factors.
PlateCalibrate is not a medical device and does not provide medical, nutritional, or psychological diagnosis, treatment, or prescriptions. Always consult a doctor or registered dietitian for advice about your health, diet, or medications.
2. Eligibility and language
The service is intended for adult users and is provided in English. By using PlateCalibrate, you confirm that you are legally allowed to use the service under the laws of your jurisdiction and that you are at least the age of majority in your country (or have obtained any required parental or guardian consent).
If you are located in the European Economic Area (EEA) or the United Kingdom, you may have additional consumer and data protection rights that remain unaffected by these Terms.
3. No images of people or faces
PlateCalibrate is designed exclusively for analyzing food and meals. For privacy, safety, and legal reasons, you must not upload:
- photos showing faces or identifiable people;
- photos featuring children or minors in any way;
- images focusing on human body parts that could reasonably allow identification;
- photos taken in private settings where people have a reasonable expectation of privacy.
We may refuse to process, delete, or block access to content that violates this rule and, where appropriate, may restrict or suspend your use of the service.
4. Acceptable use
You agree not to misuse PlateCalibrate. In particular, you agree that you will not:
- upload illegal content or content that is abusive, hateful, defamatory, or infringes the rights of others;
- upload malware or use the service to attempt to hack, attack, overload, or disrupt any system or network;
- attempt to reverse engineer, decompile, or otherwise extract source code or models from the service;
- bypass or attempt to bypass any technical or security measures implemented to protect the service;
- use PlateCalibrate in any way that violates applicable law or regulation.
You are responsible for any content you upload and for your own use of the service.
5. User content and intellectual property
You remain responsible for any rights you may have in the photos and content you upload (“User Content”). By uploading User Content, you represent and warrant that:
- you have all necessary rights, licenses, and permissions to upload the content; and
- your upload does not violate any third-party rights, including copyright, privacy, or publicity rights.
By uploading User Content to PlateCalibrate, you grant us a limited, non-exclusive, worldwide, royalty-free license to process and reproduce that content solely for the purpose of operating, securing, and improving the service (for example, temporary processing to perform AI analysis and generate results).
The PlateCalibrate name, logo, website design, and underlying software are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the service except as explicitly allowed by these Terms or applicable law.
6. Third-party services and AI providers
PlateCalibrate may rely on third-party services and infrastructure, including:
- Cloudflare or similar providers for security, DDoS protection, and content delivery;
- local AI inference (for example, Ollama) hosted on our infrastructure;
- external AI APIs (for example, OpenAI) as a fallback or alternative processing mode;
- ad networks such as Google AdSense to display advertising.
These providers operate under their own terms and privacy policies. We do not control and are not responsible for the content, privacy practices, or security of third-party websites or services you may interact with through links or advertisements.
7. No medical or nutritional advice
All outputs from PlateCalibrate, including calorie estimates, percentage breakdowns, and any textual suggestions, are automatically generated for general informational purposes only.
- You must not rely on PlateCalibrate to diagnose, treat, cure, or prevent any disease or medical condition;
- You must not use PlateCalibrate to manage eating disorders or other mental health conditions;
- You should always consult a qualified healthcare professional before making changes to your diet, medication, or lifestyle.
PlateCalibrate does not make automated decisions that have legal or similarly significant effects on you. You remain fully responsible for any actions you take based on the information provided.
8. Service availability and changes
PlateCalibrate is provided on an experimental basis, “as is” and “as available”. We do not guarantee that the service will be uninterrupted, error-free, or always available. We may:
- change, update, or remove features;
- impose usage or rate limits;
- suspend or discontinue the service, in whole or in part;
- block access from specific IP addresses or regions to protect the service.
We may do so at any time, with or without notice.
9. Limitation of liability
To the maximum extent permitted by applicable law, PlateCalibrate and its operator will not be liable for:
- any indirect, incidental, consequential, special, or punitive damages;
- any loss of data, profits, revenue, goodwill, or business opportunities;
- any health outcomes, dietary decisions, or lifestyle changes you make based on the service.
Our total liability for any claims arising out of or in connection with your use of PlateCalibrate will not exceed the amount you paid (if any) for using the service in the 3 months prior to the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law (for example, for fraud or intentional misconduct).
10. Indemnity
You agree to indemnify and hold harmless the operator of PlateCalibrate from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of:
- your violation of these Terms;
- your misuse of the service;
- your infringement of any third-party rights (including copyright and privacy) through content you upload.
11. Copyright and DMCA-style complaints
Although PlateCalibrate processes images only temporarily, we respect intellectual property rights. If you believe that content processed through the service infringes your copyright, you may submit a notice to us. Your notice should include at least:
- your full name and contact details (email and postal address);
- an identification of the copyrighted work you claim is infringed;
- a description of the allegedly infringing content and, if applicable, where it appeared in our service;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf;
- your physical or electronic signature.

We will review properly submitted notices and, where reasonably feasible, take appropriate action, which may include ceasing processing of specific content. Because we generally do not store user images, our ability to take action may be limited in time.
12. Governing law and disputes
These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws principles. If you are a consumer resident in the EEA, the UK, or another country with mandatory consumer protection laws, you may also benefit from mandatory provisions of the law of your country of residence.

13. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in the service, legal requirements, or business needs. When we update the Terms, we will change the “last updated” date below. If we make material changes, we may also provide additional notice where required by law.
By continuing to use PlateCalibrate after the updated Terms take effect, you accept the new version.
